Terms of Service — Collective Finity
1. Acceptance of these Terms
By creating an account or using Collective Finity (“the Site“), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Site. The Site is operated by Wael Safan (“we“, “us“), an individual based in the Netherlands.
2. Eligibility
You must be at least 18 years old to create an account or use the Site. By registering, you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms. We do not currently verify age beyond this self-declaration.
3. Your account
- You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
- You may sign up/log in via email, or via Google, Facebook, Discord, or X/Twitter OAuth. Each provider’s own terms also apply to your use of their login service.
- You must provide accurate information when creating your account.
- We may suspend or terminate accounts that violate these Terms, are inactive for an extended period, or where we reasonably suspect fraud, abuse, or a security risk — see our Activity Log and security practices in our Privacy Policy.
- You may request deletion of your account at any time (see our Privacy Policy for how).
4. Acceptable use
You agree not to:
- Upload, share, or link to content you do not have the legal right to use
- Use the Site to infringe anyone’s copyright, trademark, or other intellectual property rights
- Attempt to gain unauthorized access to other accounts, or to the Site’s systems or infrastructure
- Use automated tools (bots, scrapers, crawlers) to access or extract data from the Site without our express permission
- Upload malware, or attempt to disrupt or overload the Site
- Harass, impersonate, or misrepresent your identity to other users
- Use the Site for any unlawful purpose, or in violation of any applicable local, national, or international law
Violation of this section may result in immediate suspension or termination of your account, at our discretion.
5. Content and intellectual property
- Music tracks, albums, and related content on the Site are either owned by us, licensed to us, or provided by artists/rights holders. At present, all music on the Site is created and uploaded solely by Wael Safan, who holds or has secured the necessary rights to publish it.
- The Collective Finity name, logo, and site design are our intellectual property and may not be used without permission.
- You may not download, redistribute, publicly perform, or commercially exploit content from the Site except as expressly permitted by the Site or applicable law (e.g. personal, non-commercial streaming use only).
- If you believe content on the Site infringes your copyright, see our Copyright Policy.
6. Advertising
The Site displays advertising, including from third-party ad networks (see our Cookie Policy for details on ad-related cookies). We are not responsible for the content, accuracy, or practices of third-party advertisements or the websites they link to.
7. Donations
The Site includes an optional donation button processed via PayPal. Donations are voluntary and non-refundable, and do not constitute a purchase of any product, service, or membership tier. Donations do not grant any special rights, ad-free access, or other benefits unless explicitly stated on the Site at the time of donation. Donations are subject to PayPal’s own User Agreement and Acceptable Use Policy. [If you plan to offer perks for donations later — e.g. ad-free access — that changes this into a paid service with additional consumer-protection obligations in many jurisdictions (e.g. refund rights, distance-selling rules in the EU). Flag this to your legal reviewer if/when you add perks.]
7a. Xfinity rewards and affiliate program
Collective Finity offers an optional rewards program where you can earn “Xfinity” points by listening, reading, and referring other users. Xfinity points have no monetary value, cannot be purchased, and cannot be exchanged for cash. Points may be redeemed for gift codes from third-party partner platforms, subject to availability, or for future benefits on our planned NovaXfinity platform.
We reserve the right to adjust earning rates, reward tiers, and available rewards at any time. Attempting to earn Xfinity through automated tools, bots, fake accounts, or self-referrals is a violation of these Terms and may result in forfeiture of points and suspension of your account.
8. Disclaimers
- The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not guarantee the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- We are not liable for any content uploaded by third parties (if/when applicable) or for the accuracy, completeness, or usefulness of any information on the Site.
9. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site. Our total liability for any claim relating to the Site will not exceed a flat €100
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site. [Confirm with a lawyer whether this clause is appropriate/enforceable given you are an individual operator, not a company.]
11. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Site or other users. You may stop using the Site and delete your account at any time.
12. Governing law and disputes
These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the competent courts of The Hague (rechtbank Den Haag), the Netherlands. [Confirm with a lawyer — as an individual operator based in NL serving a global audience, you may also want to consider whether EU consumer protection rules require you to allow EU consumers to bring claims in their own country’s courts, which can override a strict Dutch-courts clause for consumer users specifically.]
13. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the updated Terms. Material changes will be indicated by updating the “Last updated” date above.
